1. Acceptance of Terms
By accessing the Bean Solutions Co. website at beansolutions.cloud or engaging any of our services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not use our services.
2. Services
Bean Solutions Co. ("Bean Solutions," "we," "us," or "our") provides technology services including, but not limited to:
- Remote and on-site technical support for individuals and small businesses
- Custom website design and development
- Web hosting plans
- Bean Solutions Pro membership
All services are subject to availability. We reserve the right to refuse service, modify service offerings, or discontinue any service at any time with reasonable notice.
3. Quotes and Pricing
All prices listed on our website are estimates. A formal quote will be provided prior to the start of any project or service engagement. Quoted prices are valid for 30 days from the date of issue unless otherwise stated. We reserve the right to adjust pricing at any time; however, price changes will not apply to work already quoted and accepted in writing.
4. Payment Terms
Payment terms will be specified in your individual service agreement or invoice. Generally:
- One-time services are due upon completion unless a deposit arrangement is agreed upon in writing.
- Website projects may require a 50% deposit before work begins, with the remainder due upon delivery.
- Monthly hosting and membership plans are billed on a recurring basis. Failure to pay may result in service suspension.
- All invoices unpaid after 15 days may be subject to a late fee of 1.5% per month.
5. Cancellations and Refunds
For recurring plans (hosting, Pro membership), you may cancel at any time. Cancellation takes effect at the end of the current billing period — no partial-month refunds are issued. For project-based work, deposits are non-refundable once work has commenced. If Bean Solutions cancels a project without cause, any unused portion of a deposit will be refunded.
6. Client Responsibilities
You agree to:
- Provide accurate and complete information when requesting services.
- Maintain the security of any account credentials we provide.
- Respond to reasonable requests for feedback, content, or approvals in a timely manner. Delays on the client's part may affect project timelines.
- Ensure that any content you provide (text, images, logos) does not infringe on third-party intellectual property rights.
7. Intellectual Property
Upon receipt of full payment, Bean Solutions transfers ownership of all custom deliverables (website designs, code, graphics) created specifically for you to you, the client. Bean Solutions retains the right to display completed work in our portfolio unless you request otherwise in writing. Any third-party tools, frameworks, or licenses incorporated into your project remain subject to their respective terms.
8. Limitation of Liability
Bean Solutions Co. is not liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use our services. Our total liability for any claim related to a service shall not exceed the amount paid for that specific service. We do not guarantee uninterrupted or error-free operation of any hosted service; however, we will work diligently to resolve issues in a timely manner.
9. Data and Backups
While we perform regular backups on managed hosting plans, you are solely responsible for maintaining independent backups of your data. Bean Solutions is not liable for data loss under any circumstances. We strongly encourage all clients to maintain their own off-site backups.
10. Governing Law
These Terms and Conditions are governed by the laws of the United States. Any disputes arising from these terms or our services shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be settled by binding arbitration in accordance with applicable law.
11. Changes to These Terms
We may update these Terms and Conditions from time to time. When we do, we will revise the "Last Updated" date above. Continued use of our services after any changes constitutes your acceptance of the updated terms. We encourage you to review this page periodically.
